Mohammed Shami Directed to Pay Rs 4 Lakh Per Month to Wife, Daughter After Court Scrutiny

Indian pacer Mohammed Shami has been asked by the Calcutta High Court to pay Rs 4 lakh per month as maintenance to his estranged wife Hasin Jahan and daughter. This order followed a lengthy legal struggle and was viewed as a sizeable improvement from the previous amount of Rs 1.30 lakh which had been adjudicated in 2023 by a district sessions court. The ruling triggered different responses from followers on social media many of whom sympathized with Shami and believed the figure was too high. Though the judge presiding over the case clearly stated that his ruling was on solid grounds such as the exuberant income of Shami and the lifestyle to which his wife and daughter were accustomed prior to the break-up.

The court stated that Hasin Jahan who has not married since their breakup is staying on her own with their daughter and deserves a maintenance amount that is equal to the lifestyle she enjoyed during her marriage with Shami.
The judge said that it is not ethical to provide too much money but not providing enough also will not be justice. The court carefully reviewed Shami’s income and financial position and concluded that he was capable of providing a higher amount of support. It was highlighted that the maintenance should not only support Hasin’s current needs but also secure the future of their daughter.

Hasin Jahan expressed her relief and gratitude after the court’s decision. She explained that all these years she had been working hard to meet their daughter's basic needs and this was the first time in many years that she would be able to enroll her child in a good school.
She added that the previous seven years of her life have been very tough where she had to fight for her rights and suffer emotional and economic setbacks. She had initially sought the court for a considerably higher amount that comprised Rs 7 lakh per month for herself and Rs 3 lakh for their daughter. Despite the fact that the amount sanctioned finally was less than what she had demanded, she appreciated the court's decision and expressed that it was a great assistance for their future.

This case has been going on since March 2018 when Hasin Jahan registered a police complaint at the Jadavpur police station against Shami and members of his family.
The complaint was for domestic violence under the Protection of Women from Domestic Violence Act 2005. She also accused him of physical and mental abuse dowry harassment and claimed that he ceased giving financial support for her and their daughter. Apart from these charges, she also brought a serious charge about match-fixing. These accusations stunned the public and made them into wide media coverage particularly because Shami was a vital player for the Indian cricket team.

Their marriage that started in April 2014 ended up crumbling within a matter of years resulting in public feuds and court wars.
The accusations made by Hasin Jahan led to an intense investigation and also had an impact on Shami’s public image. Despite the serious allegations Shami continued playing for India but his personal life remained under a cloud. Hasin stood firm and said her aim was only to secure justice for herself and her child. She alleged that the difficulties she had experienced after the collapse of their marriage were not only emotional in nature but also that she was not able to lead a stable life for their child because she did not receive any financial help.

The court looked at the nature of the grievances the background of the marriage and the present position of both the parties prior to arriving at the Rs 4 lakh amount. It explained that the ruling was not solely a matter of financial ability but of fairness and dignity for both the woman and child.
The judge explained that although it is not appropriate to award excessively high monetary damages, it is equally inappropriate to compel the mother and child to subsist in impoverished surroundings when the father has the economic resources to ensure their support. The court emphasized the need for a balanced approach that is considerate of the husband's financial condition and also the rights of the wife and child.

In legal papers the judge stated that the wife should have the same standard of living as she had during her marriage particularly because she has not remarried and is taking care of the child herself.
Shami’s high income as an international cricketer was a key factor in the decision. The court said that financial support should not be symbolic but meaningful enough to provide real help and give the child a chance at a better future.

Since the case first began it has been followed closely by both the media and fans. It was perceived as a private matter that became public entertainment by some and as a significant instance of legal rights and justice for women who experience suffering following marriage collapses by others.
Although the court directive provided some relief to the monthly maintenance issue overall legal struggle goes on in various forms. The verdict also gives a clear message regarding the role of financially secure individuals towards their families despite separation.

Hasin Jahan's saga in the last few years has been one of frequent trips to court public utterances and attempts to bring focus to her battle.
She remained steadfast in her quest for justice despite receiving criticism and trolling on social media. With the new amount of maintenance now determined by the court she wishes to pay greater attention to her daughter's welfare and less to courtroom challenges. For Shami this is another chapter in his long-running legal troubles even as he pursues his professional cricket career.

This ruling illustrates the function of the legal framework in safeguarding the entitlements of estranged spouses and offspring and demonstrates how financial accountability does not cease with the separation. The judgment by the court stressed equitability dignity and the future of the child as its primary concern while considering the standard of living that the family was accustomed to prior to their break-up.
